A Trap
for the Unwary:
Prohibitions Against
Daycare

Imagine this
scenario:
Your on-site manager is approached by one
of your residents. The
resident indicates that they plan to open a
small day care business operated out of the
apartment.
They want to know if management has any
objection and the manager points out that the
rental agreement prohibits operating a business
out of the apartment. The
manager also points out that the area in which the apartment
building is situated is not zoned for
commercial businesses. Unfortunately,
as well intended as the manager might be in
providing this response to the resident, the
manager is wrong. Here's
why: Under
California law, all
single family residences, including rental
apartments and condominiums, can be used for
small family day care homes.
Qualifying operations are not considered
a "business use of the property."
There is no
legal requirement that providers of day care
services own their own home. Even in
situations where a rental agreement specifically
states that an apartment can only be used as a
residence, family day care is still allowed.

annual Rebuilding
Together
work day in San
Francisco

year we go to the home of an elderly San
Francisco woman for our annual Rebuilding
Together work day.
Beginning on the morning of Saturday,
April 28, we will paint, construct an access
ramp and do some yard work as we join thousands
ofpeople accross the country who will be working
to help the elderly and disabled live in warmth,
safety and independence.

Chapter
Members to Visit Capitol
Hill

The
annual Leadership and Legislative Summit of the
Institute of Real Estate Management
(IREM®) will be held from April 21st
to the 25th in Washington, D.C. The
Summit brings together leaders from both IREM
and CCIM to discuss critical industry issues
such as technology, workforce development,
business competition, and risk management. The
highlight of the Summit is the Capitol Hill
Visit Day, when IREM members join with members
of the CCIM Institute to meet with members of
Congress and their key
aides. The purpose
of the meetings is to promote awareness and
understanding of key legislative issues of
concern to the commercial real estate industry
and to communicate the industry's position on
these issues.
"Now
is the time to impact the future of our industry
and the Institute. You can make a difference by
attending the Leadership and Legislative
Summit," commented Chet Fitzel, Legislative
Chair.
Well known for innovation and
leadership, several members of the IREM San
Francisco Chapter have volunteered their time
and energy to attend the Annual Summit in
Washington D.C. Each
year our membership participation continues to
grow on our Legislative Committee due to the
interest and concern of our membership regarding
the various issues directly effecting our
industry and our communities.
